1. ABOUT THESE TERMS

These Terms of Service govern your use of stokesupply.com and any purchase you make from us. "We", "us" and "our" mean Stoke Supply Company, a New Zealand company. "You" means the person using the site or placing an order.

By using this site or placing an order, you agree to these terms. If you don't agree, please don't use the site.

These terms should be read together with our Shipping Policy, Refund Policy, Warranty Policy, Privacy Policy, and the User Manual and Installation Guide supplied with your product. Each of those forms part of these terms.

Our store is hosted by Shopify. Any purchase you make is directly with Stoke Supply Company, not with Shopify.


2. YOUR RIGHTS AS A CONSUMER

If you buy from us as a consumer, you have rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986. Those rights apply on top of anything in these terms, and nothing in these terms limits or excludes them.

Those guarantees apply to the condition of the goods we supply. They do not cover damage, failure or loss caused by how the product is installed, loaded, maintained or used after it leaves us. Sections 8 and 9 below set out your responsibilities in that respect.


3. BUSINESS AND TRADE CUSTOMERS

If you acquire goods from us for the purposes of a business or trade — including resale, hire, commercial, rental or fleet use — then:

  • The Consumer Guarantees Act does not apply to that supply, and both parties agree to contract out of it under section 43(2) of that Act.

  • Sections 9, 12A and 13 of the Fair Trading Act do not apply, and both parties agree it is fair and reasonable to contract out of them under section 5D of that Act.

  • You confirm you are acquiring the goods in trade, that you have had the opportunity to take independent advice, and that contracting out is fair and reasonable in the circumstances.

  • Our total liability to a trade customer is limited to the price paid for the product, and we are not liable for any indirect or consequential loss, loss of profit, loss of hire income, or business interruption.

You must tell us before ordering if you are buying for business, commercial or rental use. Commercial and rental use is not covered by our warranty unless we have approved it in writing.


4. ORDERS

  • Placing an order is an offer to buy. A contract forms only when we accept your order and confirm it by email.

  • We may decline or cancel any order at our discretion — including where we cannot supply the item, where a price or description was wrong, or where we suspect fraud. If we cancel, we refund you in full and that is the limit of our obligation.

  • You are responsible for the accuracy of your order and your delivery details. Costs caused by incorrect details you supply are yours.

  • By placing an order for a rooftop tent, awning or mounting product, you confirm you have read section 8 below and that your vehicle and roof racks meet the stated requirements.


5. PRICING AND PAYMENT

  • All prices are in New Zealand dollars and include GST. Shipping is calculated separately at checkout and shown before you pay.

  • Prices may change without notice. The price that applies is the one confirmed in your order confirmation.

  • Where a price or description is obviously incorrect, we may cancel and refund rather than honour the error.

  • Third-party payment options such as Afterpay are governed by that provider's own terms.


6. PRE-ORDERS AND DEPOSITS

  • Pre-order items are allocated to a future production batch. The product page shows which shipment yours is on.

  • Pre-orders may be secured by a deposit, with the balance payable before dispatch. Your unit is not allocated until the deposit is received, and is not dispatched until the balance is paid.

  • If the balance is not paid within 14 days of our request, we may cancel the order and re-allocate the unit. In that case we will refund the deposit less any costs we have already incurred.

  • Deposits are refundable up until we commit your unit to the production batch. We will tell you when that point is reached. After that, we may retain a reasonable amount reflecting the costs we have committed on your behalf, and will refund the balance.

  • Lead times and shipment dates are estimates given in good faith, not guarantees. Manufacturing, freight and customs timing can move. Estimated dates are not a term of the contract.

  • If a shipment is materially delayed, we will tell you, and you may cancel for a full refund of amounts paid.


7. DELIVERY AND RISK

  • Delivery timeframes are estimates. We are not responsible for delays caused by freight carriers, weather, customs or other events outside our reasonable control.

  • Risk in the goods passes to you on delivery to your address, or on collection from the freight depot.

  • You must inspect your order on arrival and report any transit damage within 48 hours, with photographs of both the packaging and the product, through our Warranty Form. This window exists because our freight partners impose it on us; late reports may prevent us recovering a claim.

  • Signing for delivery without noting visible damage may limit what can be claimed from the carrier.


8. FITMENT, INSTALLATION AND SAFE USE

This section is important. It concerns your safety, the safety of other road users, and the limits of our responsibility.

Our products are mounted to vehicles and carried at speed on public roads. Correct fitment, installation and use are your responsibility. The User Manual and Installation Guide supplied with your product forms part of these terms, and you must follow it.

You must, at minimum:

  • Fit crossbars or a roof rack rated above the weight of the product. Crossbars are mandatory and are not supplied with the tent.

  • Verify your vehicle's dynamic and static roof load ratings against the combined weight of the product, your racks and any other load. These figures come from your vehicle manufacturer. Any guidance we provide is assistance only and does not replace your vehicle manufacturer's specifications or your rack manufacturer's ratings.

  • Meet the mounting requirements set out in the manual, including minimum crossbar span, minimum roof-to-bar clearance, and maximum crossbar tube width.

  • Never mount to glass. On vehicles with a panoramic roof or sunroof, crossbars must be mounted to the metal body only.

  • Check fitment after the first 50 km of driving, and check all mounting hardware before every trip.

  • Observe the stated speed limit — do not exceed 110 km/h with the product mounted, and reduce speed for road, weather and load conditions.

  • Observe the stated wind limits — do not use the tent deployed in sustained winds above 40 km/h (20 knots). Close and latch the hard-shell in storms, gales or heavy snowfall.

  • Never drive with the shell partially open or with fabric caught in the shell. Confirm both latches are fully engaged before driving.

  • Do not exceed rated capacities, including sleeping capacity and accessory crossbar load limits.

  • Do not modify the product or use it with incompatible or unrated racks, brackets or fixtures.

  • Maintain the product as specified, including drying it fully before closing and storage.

If you are not confident installing the product, have it fitted by a qualified installer. If you are unsure whether your vehicle or racks are suitable, contact us before you buy.

We are not liable for any loss, damage or injury arising from: incorrect or incomplete installation; use of incompatible, unrated or incorrectly fitted racks, bars or fixtures; exceeding roof load ratings or product capacities; exceeding stated speed or wind limits; driving with the shell unlatched or fabric caught; modification of the product; failure to carry out the checks required above; or any use contrary to the manual.

This section does not limit your rights under the Consumer Guarantees Act in respect of a defect in the goods as supplied.


9. WARRANTY

Our products carry a 12-month warranty against defects in materials and workmanship affecting normal use — the Stoke Promise. This is a voluntary warranty given in addition to your rights under the Consumer Guarantees Act.

The warranty:

  • runs for 12 months from the date of delivery;

  • applies to the original purchaser only and is not transferable;

  • requires proof of purchase;

  • is limited, at our discretion, to repair, replacement or refund; and

  • does not cover the cost of removal, reinstallation, or any loss arising while a claim is assessed.

The warranty does not cover: normal wear and tear; incorrect installation or use outside the manual; overloading beyond rated capacity; accidental damage or misuse; modification; use with incompatible or unrated racks or fixtures; mould or mildew from storing the product wet; UV, weather or surface degradation over time; damage from coastal, salt or off-road contamination not cleaned as specified; loss or theft; or commercial or rental use unless approved by us in writing.

10. RETURNS

Change-of-mind returns are offered at our discretion, in addition to your statutory rights. To qualify, the product must be unused, uninstalled, in original condition and in its original packaging, and the request made within the period stated in our Refund Policy.

  • Return shipping is at your cost and risk. We recommend insuring the return.

  • Original shipping charges are not refunded.

  • Products that have been installed, mounted to a vehicle, or used are not eligible for change-of-mind return.

  • We may deduct a reasonable amount for any reduction in value where a product is returned in less than original condition.

None of this affects your right to a remedy under the Consumer Guarantees Act where a product is faulty.


11. LIABILITY

Nothing in this section limits or excludes: your rights under the Consumer Guarantees Act or Fair Trading Act if you acquire goods as a consumer; liability for death or personal injury caused by our negligence to the extent it cannot lawfully be excluded; or liability for fraud.

Subject to that, and to the maximum extent permitted by law:

  • We are not liable for indirect or consequential loss, loss of profits, loss of use, loss of enjoyment, travel or accommodation costs, vehicle damage, or loss of opportunity arising from the supply or use of our products.

  • Where our liability can lawfully be limited, our total liability in connection with any product is limited to the amount you paid for that product.

  • We are not liable for loss or damage caused by events outside our reasonable control.

  • We are not liable for the performance, rating or suitability of third-party roof racks, crossbars, platforms or vehicle fittings.

New Zealand's accident compensation scheme applies to personal injury in New Zealand and generally bars proceedings for compensatory damages for personal injury covered by that scheme.


12. YOUR INDEMNITY

You indemnify us against any claim, loss, damage or cost (including reasonable legal costs) brought by a third party and arising from: your installation or use of the product contrary to the manual or section 8; your use of incompatible, unrated or incorrectly fitted racks or fixtures; your modification of the product; or your breach of these terms.

This indemnity does not apply to the extent the claim arises from a defect in the goods as supplied by us, and does not apply to consumers to the extent it would be unenforceable at law.


13. PRODUCT INFORMATION

  • We describe our gear as accurately as we can, including weights, dimensions and specifications. Where a specification is not final, we say so.

  • Specifications are subject to change. Contact us for confirmed product details before ordering if a specific figure matters to your decision.

  • Colours and appearance may differ slightly from how they appear on your screen.

  • We may change or discontinue products, and correct errors in descriptions, pricing or availability, at any time.


14. INTELLECTUAL PROPERTY

All content on this site — text, images, video, graphics, logos and designs — is owned by Stoke Supply Company or our licensors and is protected by New Zealand and international intellectual property law.

You may use the site for your own personal, non-commercial purposes. You may not copy, reproduce, republish or distribute our content without our written permission.


15. USING THIS SITE

Don't use the site for anything unlawful, don't interfere with its security or operation, and don't scrape, spam or misuse it. We may suspend access if you do.

If you send us feedback, reviews or suggestions, you grant us permission to use them, including publicly and for marketing.


16. PRIVACY

We handle your personal information in accordance with our Privacy Policy and the Privacy Act 2020.


17. CHANGES TO THESE TERMS

We may update these terms from time to time. The version that applies to your order is the version published when you placed it.


18. GOVERNING LAW AND DISPUTES

These terms are governed by New Zealand law, and the New Zealand courts have exclusive jurisdiction.

If something goes wrong, contact us first — most things are resolved by email.
